Information About Withdrawal
Right of Withdrawal
You have the right to withdraw from this agreement within 30 days without giving any reason.
The withdrawal period is 30 days from the date:
-
On which you, or a third party designated by you (other than the carrier), take possession of the goods, if you ordered one or more goods under a single order and they were delivered at the same time;
-
On which you, or a third party designated by you (other than the carrier), take possession of the last goods, if you ordered multiple goods under a single order and they were delivered separately.
To exercise your right of withdrawal, you must notify us of your decision to withdraw from this agreement. This can be done via email: info@kelseyandstacy.com.
You may use the attached model withdrawal form, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient that you send the notification of exercising your right of withdrawal before the withdrawal period expires.
Effects of Withdrawal
If you withdraw from this agreement, Kelsey & Stacy will reimburse all payments received from you, including delivery costs (except for additional costs resulting from your choice of a delivery method other than the standard delivery offered), immediately and no later than 30 days from the date we receive your withdrawal notification.
For this reimbursement, we will use the same payment method you used in the original transaction, unless expressly agreed otherwise. Under no circumstances will this reimbursement incur additional costs for you.
Kelsey & Stacy may withhold reimbursement until:
-
The returned goods have been received, or
-
You have provided evidence that you have returned the goods, whichever occurs first.
You must return or hand over the goods immediately and no later than 30 days from the date you informed us of your withdrawal.
The deadline is met if you send back the goods before the 30-day period expires.
The direct costs of returning the goods are your responsibility.
You are only liable for any diminished value of the goods resulting from handling the goods beyond what is necessary to establish their nature, characteristics, and functioning.
Reasons for Exclusion and Expiry of the Right of Withdrawal
The right of withdrawal does not apply to contracts:
-
For the supply of goods that are not prefabricated and are made based on an individual choice or decision of the consumer;
-
For the supply of goods that are perishable or have a limited shelf life;
-
For the supply of alcoholic beverages whose price was agreed upon in the contract, but which can only be delivered at the earliest 30 days after the contract was concluded and whose value depends on market fluctuations;
-
For the supply of newspapers, magazines, or periodicals, except for subscriptions.
The right of withdrawal expires prematurely for contracts:
-
For the supply of sealed goods that are not suitable for return for health or hygiene reasons if the seal is broken after delivery;
-
For the supply of goods which, after delivery, have been inseparably mixed with other goods due to their nature;
-
For the supply of audio or video recordings and computer software in a sealed package if the seal is broken after delivery.
